UNREAL Mobile offers a variety of monthly plans (each a "Monthly Plan") for its voice and text messaging service to landline and mobile phones in the United States, excluding Puerto Rico and other U.S. territories, (the "Phone Service"). At UNREAL Mobile, we want all of our customers to get the best Monthly Plans for Phone Service at the lowest possible price. This Fair Usage Policy ("FUP") is designed to prevent fraud and abuse of our services by a small number of users.
Minute Fair Usage. Subject to this FUP, certain UNREAL Mobile Monthly Plans allow unlimited calls to landline and mobile phones in the United States, excluding Puerto Rico and other U.S. territories, and unlimited text messages ("Unlimited Monthly Plans"). Calls to landline and mobile phones in the United States, excluding Puerto Rico and other U.S. territories, are included in your Unlimited Monthly Plan subject to a usage limit of 2,500 minutes per month, per Unlimited Monthly Plan. The maximum duration for a call using an Unlimited Monthly Plan is 12 hours. The minutes included in each Monthly Plan do not roll over from month to month and will be lost if not used within that month. Once the minutes included in your Monthly Plan have been used, you may not use additional minutes for the balance of the month.
UNREAL Mobile's Phone Service is for personal use only in accordance with our Acceptable Use Policy and this FUP ("Legitimate Use"). The following is a non-exhaustive list of practices that would not be considered Legitimate Use:
Using Phone Service for telemarketing or call center operations;
Re-selling Phone Service minutes;
Sharing Phone Service between users whether via a PBX, call center, computer or any other means;
Calling numbers (whether singly, sequentially or automatically) to generate income for yourself or others as a result of placing the call; and
Unusual calling patterns inconsistent with normal, personal use, for example, regular calls of short duration or calls to multiple numbers in a short period of time.
Other practices may be relevant in determining Legitimate Use and UNREAL Mobile reserves the right to take any unlawful, prohibited, abnormal, or unusual activity into account in making its determination. UNREAL Mobile may at its sole discretion, terminate its relationship with you, or may suspend your Phone Service immediately if it determines you are using your Monthly Plan contrary to this FUP or UNREAL Mobile's Acceptable Use Policy. Where reasonable, UNREAL Mobile will provide you with notice of improper usage before suspension or termination of your Monthly Plan and, if appropriate, UNREAL Mobile may offer you an alternative Monthly Plan.
The Phone Service is intended for everyday personal calling and not for mass marketing calls. UNREAL Mobile may monitor for mass marketing calls and reserves the right to revoke the use of the Phone Service with immediate effect if UNREAL Mobile suspects that the Phone Service being used in this manner.
Text Message Fair Usage. Text messages are included in your Unlimited Monthly Plan subject to a usage limit of 5,000 text messages per month, per Unlimited Monthly Plan. Use of the Phone Service in excess of 5,000 text messages per month is excessive use and is a violation of UNREAL Mobile's FUP. Once the text messages included in your Monthly Plan have been used, your text usage will be suspended for the balance of the month.
Data Fair Usage. Certain UNREAL Mobile Monthly Plans allow unlimited data ("Unlimited Monthly Data Plans"), subject to this FUP. Up to a predetermined amount of data is included in your Unlimited Monthly Data Plan at up to 4G speed. After such predetermined amount of data is reached in a given month, all additional data under your Unlimited Monthly Data Plan for the month will be throttled to a slower speed.
You must also ensure that your use of your Unlimited Monthly Data Plan does not restrict, inhibit, interfere with, or degrade any other person's use of our services, nor represent (as determined by UNREAL Mobile in its sole discretion) an overly large burden on the network. In addition, you must ensure that your use of your Unlimited Monthly Data Plan does not limit or interfere with UNREAL Mobile's ability to deliver and monitor the its broadband service or any part of its network. Where reasonable, UNREAL Mobile will provide you with notice of improper usage before suspension or termination of your Unlimited Monthly Data Plan and, if appropriate, UNREAL Mobile may offer you an alternative Monthly Plan.
Video Compression. UNREAL Mobile currently uses video compression that allows you to watch more videos on your wireless devices while using less data by streaming content that it recognizes as video at Standard Definition quality, similar to DVD (about 480p), so you can enjoy more on your smartphone or tablet. Video compression is designed to identify streaming video content so that data speed and resolution of higher definition video can be adjusted to Standard Definition quality (about 480p). This allows customers to stream more video while using the same amount of data. Video compression only applies to video streamed over the cellular network. Video streamed over Wi-Fi is not affected.
Video compression will not apply to content it cannot identify as video. Additionally, your ability to stream and the resolution of video may be affected by other factors, such as the source of the video and type of device being used. Therefore, video compression may not be able to recognize all video content, and any unrecognized higher resolution video will continue to stream at its normal speed and resolution. To the extent these factors may apply, the user's data may be throttled to a slower speed after the customer has exceeded their data usage. We are continuously working to improve the ability for video compression to identify video content so that we add video streaming sources.
Changes to UNREAL Mobile's FUP. UNREAL Mobile reserves the right to change this fair usage policy at any time. Changes shall become effective when published on the UNREAL Mobile website. Your continued use of the Phone Service after publication of the revised version shall constitute your acceptance to be bound by the terms and conditions of the revised fair usage policy.
